These Terms of Service ("Terms") form a binding agreement between you and PEAKSERVE GLOBAL PRIVATE LIMITED, a company incorporated under the Companies Act, 2013 of India, with its registered office at 2639/197, Onkar Nagar, Tri Nagar, Delhi, North West Delhi, India - 110035 ("Paramatma", "Company", "we", "us", or "our"). These Terms govern your access to and use of the Paramatma mobile applications, the website at https://www.paramatma.co.in, and all related features and services (the "Services").
PLEASE READ THESE TERMS CAREFULLY. They contain important provisions affecting your legal rights, including limitations on our liability (Section 16), a time limit for bringing claims (Section 22), and a governing-law and dispute-resolution clause (Section 19). If you are a consumer with non-waivable statutory rights in your jurisdiction, those rights are preserved and any conflicting provision does not apply to you.
By installing, accessing, or using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not install or use the Services.
1Definitions
- "Account" means the account you create to access the Services.
- "Content" means text, images, counts, group and profile information, birth details, and any other material you submit to or generate within the Services.
- "Mudra" means the in-app virtual currency described in Section 4, usable only within the Services and having no monetary value.
- "Sangh" means a group you create or join to practise alongside other users.
- "Kundali" means the AI-assisted reading feature described in Section 6.
2Eligibility and Accounts
In Short: You must be old enough to use the app, keep your login secure, and give us accurate information.
You must be at least 13 years old (or the higher minimum age required in your country) to use the Services. By using the Services you represent that you meet this requirement and have the legal capacity to enter into these Terms. You are responsible for the accuracy of the information you provide, for maintaining the confidentiality of your credentials, and for all activity under your Account. Notify us at support@paramatma.co.in of any unauthorised use.
3Licence to Use the Services
In Short: We give you a personal, limited licence to use the app for your own devotional practice.
Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable licence to download and use the Services for your own personal, non-commercial devotional and wellbeing use. We reserve all rights not expressly granted.
4Subscriptions, In-App Purchases, and Mudra
In Short: Paid plans and Mudra are billed by Apple or Google. Mudra is a digital-only in-app currency with no cash value and, generally, no refunds except where the law or the store requires.
The Services are free to start. Some features, digital items, and Mudra (in-app virtual currency) are available for purchase.
- Billing. All payments are processed by the Apple App Store or Google Play Store under their own terms. We never receive your card or bank details.
- Auto-renewing subscriptions. If you buy an auto-renewing subscription, it renews automatically at the end of each period unless you cancel at least 24 hours before the period ends. Manage or cancel subscriptions in your Apple or Google account settings, not in the app. See our Support page for step-by-step instructions.
- Mudra. Mudra is a limited, revocable licence to a digital feature. It is not money, has no monetary value, cannot be exchanged for cash, and is non-transferable outside the Services. Mudra and any digital items are consumed within the app and are generally non-refundable once delivered, except where refunds are required by applicable law or the store's policies. We may change Mudra pricing, earn rates, and the items it unlocks; unused Mudra may expire on account closure.
- Refunds. Refund requests are handled by Apple or Google according to their policies. We do not separately process store payments.
- Taxes. Prices may include applicable taxes as determined by the store.
5Digital Wellbeing — No Medical Advice
In Short: The detox and focus features support your habits; they are not healthcare and are not a substitute for professional help.
The digital-detox, focus, and reminder features are provided for general wellbeing and habit support only. They are not medical devices, do not provide medical, psychological, or clinical advice, and are not a diagnosis, treatment, or substitute for professional care. If you are struggling with your mental health or device use, please consult a qualified professional. Do not disregard or delay seeking professional advice because of anything in the Services.
6Kundali and AI-Assisted Content
In Short: The Kundali reading is generated by AI for reflection and general interest. It is not professional advice and is not guaranteed to be accurate.
The Kundali feature and other AI-assisted content are generated by automated systems for personal reflection, cultural interest, and entertainment. They are not professional advice of any kind (including astrological, medical, legal, financial, or psychological advice), may be inaccurate or incomplete, and must not be relied upon to make important decisions. You are responsible for how you use any reading. By using AI features you acknowledge you are interacting with an artificial intelligence system and consent to the processing described in our Privacy Policy.
7Community, Sangh, and Acceptable Use
In Short: Be respectful in groups. Don't harass, spam, or misuse other members' information.
When you create or join a Sangh, you can share your display name, activity, and nudges with other members. You agree to treat other members respectfully and to use community features only for their intended devotional and supportive purpose. You are responsible for the invitations you send and for the content and conduct you contribute. We may remove groups or content, and suspend accounts, that violate these Terms.
8Your Content and Licence to Us
In Short: Your Content stays yours. You give us only the permission we need to run the features you use.
You retain all rights in your Content. You grant us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, and process your Content solely to operate, provide, secure, and improve the Services for you (for example, to sync your counts, show your leaderboard position to your Sangh, or generate your Kundali reading). This licence ends when you delete the Content or your Account, except for content already shared with other users (Section 14) and residual backup copies overwritten in the ordinary course. You represent that you have the rights to the Content you submit.
9Prohibited Conduct
In Short: Don't break the law, abuse the app, or harm other people.
You agree not to: use the Services for any unlawful purpose; harass, threaten, impersonate, or defame others; upload content that is unlawful, hateful, obscene, or infringing; attempt to access another user's account or data; reverse-engineer, decompile, or circumvent security or usage limits (including manipulating counts, streaks, leaderboards, or Mudra); use bots or automated means to interact with the Services; introduce malware; or interfere with the integrity or performance of the Services.
10Intellectual Property
In Short: The app, its design, and its content (other than your Content) belong to us or our licensors.
The Services, including software, design, text, graphics, logos, and iconography (other than your Content), are owned by Paramatma or its licensors and are protected by intellectual-property laws. The "Paramatma" name and logo are our marks. Nothing in these Terms transfers ownership to you.
11Third-Party Services
In Short: The app relies on Apple, Google, and AI providers. Their terms apply to their parts.
The Services integrate third-party services, including Apple, Google (sign-in, billing, notifications, and Gemini), OpenAI, and cloud infrastructure providers. Your use of those services is subject to their own terms and privacy policies. We are not responsible for third-party services and do not endorse them.
12Devotional Content and Respectful Use
In Short: Paramatma is a devotional app for personal practice; use it respectfully.
Paramatma presents deity names, mantras, imagery, and other devotional material drawn from the Sanatana tradition and from public-domain or licensed sources. It is provided to support your personal practice and is offered with respect for the traditions it draws upon. You agree to use this material respectfully and not to modify, extract, or redistribute it in a manner that is unlawful or that misuses religious content.
13Privacy
Your use of the Services is subject to our Privacy Policy, which explains how we collect, use, and protect your personal data, including special-category data revealing religious or spiritual belief.
14Termination
In Short: You can stop anytime and delete your account. We can suspend accounts that break these Terms.
You may stop using the Services and delete your Account at any time (see our Account Deletion page). We may suspend or terminate your access if you materially breach these Terms, if required by law, or to protect the Services or other users. On termination, your licence to use the Services ends. Sections that by their nature should survive (including Sections 8, 10, 15–17, 19, and 22) survive termination. Content you shared with other members (such as within a Sangh) may remain visible to them.
15Disclaimers
In Short: The Services are provided "as is". We don't promise they'll be perfect or uninterrupted.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. We do not warrant that the Services will be uninterrupted, secure, error-free, or that counts, streaks, or AI outputs will be accurate. Nothing in this Section limits warranties that cannot be excluded under the law applicable to you as a consumer.
16Limitation of Liability
In Short: There's a cap on what we owe you if something goes wrong.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PARAMATMA AND ITS OFFICERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES. OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) INR 5,000 (OR ITS EQUIVALENT). Some jurisdictions do not allow certain limitations, so some may not apply to you; nothing here limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded by law.
17Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless Paramatma from claims, damages, and expenses (including reasonable legal fees) arising from your Content, your misuse of the Services, or your breach of these Terms, except to the extent caused by us.
18Changes to the Services and These Terms
In Short: We may update the app and these Terms; we'll flag material changes.
We may modify, suspend, or discontinue features at any time. We may update these Terms; where changes are material, we will provide reasonable notice (for example, by email or in-app notice) before they take effect. Your continued use after the effective date constitutes acceptance. If you do not agree, stop using the Services.
19Governing Law and Dispute Resolution
In Short: Indian law governs. Disputes are resolved in Delhi, by arbitration where permitted.
These Terms are governed by the laws of India, without regard to conflict-of-laws rules. Subject to any non-waivable consumer rights in your jurisdiction, the courts at Delhi, India will have jurisdiction, and the parties may resolve disputes by arbitration seated in Delhi under the Arbitration and Conciliation Act, 1996, before a sole arbitrator, in English. Nothing prevents either party from seeking injunctive relief to protect its intellectual property.
20Apple App Store — Additional Terms
In Short: Standard Apple-required terms for apps downloaded from the App Store.
These Terms are between you and Paramatma only, not with Apple. Apple is not responsible for the Services or their content. Your licence to use the app on Apple devices is limited to use on Apple-branded products you own or control, as permitted by the App Store Terms. Apple has no obligation to provide maintenance or support. To the maximum extent permitted by law, Apple has no warranty obligation, and any claims, losses, liabilities, or expenses attributable to a failure to conform to any warranty are our responsibility, not Apple's. Apple is not responsible for addressing product or third-party intellectual-property claims relating to the app. You represent that you are not in a country subject to a U.S. Government embargo or designated as "terrorist-supporting", and that you are not on any U.S. Government restricted-parties list. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
21Google Play — Additional Terms
In Short: Standard Google-required terms for apps downloaded from Google Play.
If you obtained the app from Google Play, your use is also subject to the Google Play Terms of Service. These Terms are between you and Paramatma only, not with Google, and Google is not responsible for the Services.
22Time Limit for Claims
To the extent permitted by law, any claim arising out of or relating to the Services or these Terms must be commenced within one (1) year after the claim arose; otherwise it is permanently barred.
23General
These Terms, together with the Privacy Policy, are the entire agreement between you and Paramatma regarding the Services. If any provision is held unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. Headings are for convenience only.
